Brookvale AV Terms & Conditions (Also referred to as Terms of Hire)




  • Definitions
  •  

    1. “equipment”, “gear”, “goods” means the items hired out by Brookvale AV.
    2. “customer”, “client”, “hirer” means any person requesting to hire gear or enquiring to Brookvale AV or Brookvale AV’s staff.
    3. “staff”, “team”, “contractors”, “crew”, “support team” refers to the employees or workers at Brookvale AV.
    4. “owners” refers to the owner of Brookvale AV.



  • General

      1. These Terms of Hire are subject to change at anytime without notice.
      2. These Terms of Hire are intellectual property of Brookvale AV and can not be changed, copied, distributed, published, printed or modified without written consent from the owner.
      3. Brookvale AV reserves the right to refuse service to a customer at any time. Brookvale AV and it’s staff do not have to provide a reason for refusal to customers. 
      4. Customers are required to agree to our Terms of Hire before collecting any equipment.
      5. If a customer would like to authorise someone else to pick up their equipment, then the customer will need to contact us in writing. 
      6. Customers understand that the event could be changed due to reasons outside of Brookvale AV's control such as venue policies or requirements.
      7. Customers understand that Brookvale AV has the right to use sub contracted services or external companies to fulfil our services.
      8. Customers understand that we may not be able to repair, fix or resolve customer related issues, installs or equipment.
      9. Customers understand that if services or resources are reduced then event and AV outcomes may differ or not meet original expectation.  
      10. Customers understand that Brookvale AV may not deliver exact outcomes due to uncontrollable reasons.
      11. Customers understand that Brookvale AV is not responsible for in house equipment or other client/venue supplied equipment.
      12. Customers understand payment is required upfront for all services & sales unless specifically stated in writing for each invoice.
      13. Brookvale AV reserves the right to substitute equipment or products with alternate options, this includes hire and install goods.
      14. Brookvale AV is not responsible for delay in work or supplying of gear due to external delays such as but not limited to; venues, promoters, security, etc 
      15. Brookvale AV is not responsible for gear that is faulty, not working properly, not in good order, not functioning correctly. 
      16. Brookvale AV is not liable for client equipment malfunctions or client supplied equipment.
      17. Brookvale AV reserves the right to decide on cancellation and refund reasons and if those reasons are reasonable.  
      18. Additional damage or related fees beyond the security bond will be charged to the customer's card or sent to the customer as invoice for immediate payment. 
      19. Brookvale AV requires full payment for events, installs and equipment to be confirmed. We reserve the right to place your event booking, install or order on hold until we receive payment.

     

  • Pickup of Equipment 
  •  

    1. Brookvale AV requires an Australian Driver’s Licence or a state issued Photo ID Card upon collection. Brookvale AV will temporarily store a copy of your ID until the equipment is returned in a satisfactory condition. 
    2. Brookvale AV reserves the right to change or alter pickup times.
    3. Brookvale AV requires a payment as a bond for the equipment that you are hiring. The bond amount is different based on the equipment that you have hired. If you can not pay a bond, then your hire may be canceled. 
    4. Brookvale AV reserves the right to reject the customer's identification for any reason.
    5. Brookvale AV requires an over 18+ customer to pickup the goods and sign the Terms of Hire when booking online. Customers under the age of 18 will not be able to hire equipment from Brookvale AV without an over 18 completing the booking and pickup on their behalf.
    6. Customers should seek any technical assistance at the time of pickup to avoid questions when setting up equipment on site.
    7. If a customer fails to pickup their equipment, Brookvale AV will go to all efforts to try and contact the customer before canceling the hire.
    8. Customers understand when they are on the property of Brookvale AV they do not have permission to film, photograph or record our site.
    9. Customers are reminded that a 1 day hire equals a maximum of 24 hours, all gear must be returned the following morning to avoid additional fees.




  • Stolen or Damaged Equipment
  •  

    1. Brookvale AV reserves the right to inspect our equipment at anytime including during a hire.
    2. Customers are required to immediately notify us regarding any damage, theft or changes to our equipment. Customers are reminded that if we are aware of damage or theft earlier then generally the fees to the customer will be less.
    3. Customers must prevent any further damage to equipment. This means customers should immediately packup the equipment and arrange a time to return it earlier if possible.
    4. Damaged equipment means we need to cancel other bookings, customers may be required to compensate Brookvale AV until the equipment is repaired or replaced. 
    5. Customers must be able to present all of the equipment at any time as requested by Brookvale AV.
    6. The customer is fully liable for all equipment losses, damage or change of condition excluding usual wear and tear as determined solely by Brookvale AV staff. This includes any liquid damage, sun damage, dirt, intentional or reckless damage. Brookvale AV uses technology and inspection to assess equipment upon return.
    7. Alterations to our equipment such as different cables or hardware is still considered damage.
    8. Brookvale AV may inspect equipment during the return or after the return. We will hold the customer’s bond or pre authorisation until we are completely satisfied with the condition of the equipment.
    9. Brookvale AV includes the changes or losses of software and subscriptions provided by Brookvale AV as damage.  
    10. Brookvale AV reserves the right to charge our own replacement fees regardless of equipment retail pricing, this is due to the extra work and costs of setting up new equipment.



  • Return of Equipment
  •  

    1. Brookvale AV requires the customer who entered the hire agreement to return the equipment. If the original customer does not return the equipment Brookvale AV will store the identification until the original customer contacts us.
    2. Brookvale AV will not accept unattended equipment as a satisfactory return. Customers must organise a return or return the equipment during business hours to our team.
    3. In most cases customers can return equipment earlier at no extra cost. 
    4. Customers who return equipment after the return date and time will be charged additional fees unless a prior arrangement has been made.
    5. Customers who return equipment after the return date will also be charged additional fees to cover the loss of income from other customers.



  • Risk & Safety
  •  

    1. Customers are required to follow all instructions from staff.
    2. Customers should consider their ability in setting up and operating our equipment before choosing to hire from us. 
    3. Customers are required to follow all manufacturer guidelines and read all information available to them.
    4. Customers should not operate equipment in unsafe conditions such as; extreme temperatures, rain, snow, hail, uneven surfaces, etc.
    5. Customers should seek guidance and instruction from staff when needed. 
    6. Customers should drive safely, slowly and consider how they secure the hire equipment in their car. 
    7. Customers should consider how rain and water can damage equipment and that a different setup may be required.
    8. Customers must provide correct power and connections to Brookvale AV gear, otherwise we may cancel the event on the spot.
    9. Customers are liable for equipment not setup correctly.

     

  • Marketing
  •  

     

    1. Customers consent to providing their contact details for marketing purposes such as newsletters, follow ups, etc
    2. Customers understand photos of their event may be used for published media or social media to promote Brookvale AV.
    3. Customers who don't wish to provide their info or allow photos must notify us in writing before their event.
